Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "customer") and Sindhi Dry Fruits ("we", "our", "us"), operator of the website sindhidryfruits.live (the "Store").

By accessing, browsing, or purchasing from the Store, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and our Shipping Policy. If you do not agree, you must stop using the Store.

You may use the Store only if:

• You are at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872; or
• You are accessing the Store under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

If you are placing an order on behalf of a company, you confirm that you are authorised to bind that company to these Terms.

You may browse the Store without an account, but some features (order history, saved addresses, faster checkout) require one. You are responsible for keeping your login credentials confidential and for all activity that takes place under your account. Notify us immediately at contact@sindhidryfruits.live if you suspect unauthorised access. We may suspend or terminate accounts that we reasonably believe are being used for fraud, abuse, or in breach of these Terms.

We list products with photographs, descriptions, weights, nutrition information, ingredients, and prices. We take reasonable care to be accurate, but product photographs are illustrative and packaging may vary. Natural products (nuts, seeds, dried fruit, makhana) vary slightly in size, colour, and texture from batch to batch.

All prices are quoted in Indian Rupees (INR), are inclusive of GST as required by the Central Goods and Services Tax Act, 2017, and exclude shipping charges (which are calculated at checkout). We reserve the right to correct any typographical error in price or description before accepting your order. If a price error has occurred, we will contact you before dispatch and offer a full refund or the corrected price for confirmation.

The display of products on the Store is an invitation to treat, not a binding offer. When you place an order through checkout, you make an offer to buy. The contract of sale is concluded only when we send you an order confirmation email or WhatsApp message.

We may decline an order, in full or in part, for reasons including:

• The product is out of stock
• A price or description error
• Inability to verify your address or contact details
• Suspected fraud or breach of these Terms
• Delivery is not feasible to your pincode

If we decline an order after payment, we will refund the full amount in accordance with our Refund Policy.

In addition to the reasons listed above, we may cancel an order at any time before dispatch if, in our reasonable judgement, fulfilling it would breach the law, expose us to undue risk, or cannot be done to our quality standards. In such cases we will refund you in full and notify you of the cancellation by email or WhatsApp.

Checkout on the Store is provided by Fastrr (Shiprocket Checkout). Payments through the Fastrr checkout are processed by Razorpay Software Pvt. Ltd., a Reserve Bank of India-licensed payment aggregator. We accept the following payment methods: UPI (GPay, PhonePe, Paytm, BHIM), credit and debit cards (Visa, Mastercard, RuPay, American Express), Net Banking, and popular wallets. Cash on Delivery, where available, is confirmed at checkout based on your pincode and order value.

We do not store your full card number, CVV, or UPI PIN. All sensitive payment data is handled by Razorpay on PCI-DSS-compliant infrastructure.

Orders are shipped pan-India through Shiprocket and its carrier network. Dispatch and delivery timelines and tracking information are set out in full in our Shipping Policy. Risk in the goods passes to you on delivery to the address you specified at checkout.

We offer a 7-day return window for eligible items, subject to food-safety carve-outs and conditions set out in full in our Refund Policy. Please read that policy carefully before placing an order.

To the maximum extent permitted by law:

• The Store and products are provided "as is". We make no warranties or representations other than those expressly set out in these Terms or required by Indian consumer protection law.
• We shall not be liable for any indirect, special, incidental, consequential, or punitive loss, including loss of profit, loss of business, or loss of goodwill, arising out of or in connection with your use of the Store or our products.
• Our total aggregate liability to you in respect of any one order shall not exceed the amount you paid for that order.

Nothing in these Terms limits or excludes any liability that cannot legally be limited or excluded, including liability for death or personal injury caused by our negligence, or under the Consumer Protection Act, 2019.

We are not liable for any failure or delay in performing our obligations that is caused by events beyond our reasonable control, including acts of God, natural disasters, fire, flood, pandemic or epidemic, war, terrorism, civil unrest, government action, courier strikes or shutdowns, internet or hosting outages, or failure of utilities. In such cases we will make reasonable efforts to notify you and to resume performance as soon as practicable.

These Terms are governed by and construed in accordance with the laws of India. Subject to the dispute resolution clause below, the courts at New Delhi shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Store.

Before initiating any formal proceedings, you agree to first contact us at contact@sindhidryfruits.live with a clear description of your concern. We will work in good faith to resolve disputes within 30 days.

If a dispute cannot be resolved amicably, it shall be referred to arbitration by a sole arbitrator and more investigated under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be New Delhi and the language shall be English.

We may update these Terms from time to time to reflect changes in our business, our products, or applicable law. The updated version will be posted on this page with a new "Last Updated" date. For material changes we will give reasonable advance notice by email, WhatsApp, or a banner on the Store. Your continued use of the Store after the changes take effect constitutes your acceptance of the updated Terms.
